Blasphemy Law has NO Qur'anic Basis

More articles on the topic at www.BlasphemyLaws.com

Some Muslim countries have legislated punishment for blasphemy. This draws on the Classical Sharia (Law) of Islam that evolved in the medieval ages and was inevitably informed by the historical realities and entrenched customs and practices of the era. However, with a sea change in civilizational paradigms, many of its rulings suffer anachronism, stand in conflict with international human rights charters and conduce to injustice, anarchy and barbarism in today's politically volatile and globalized world. All such rulings need to be examined in light of the universal message of the Qur'an which is by far the highest and incontestable authority in Islam.

This essay - an exercise in ijtihad (intellectual scrutiny with the limits set by God) investigates the case of blasphemy. It draws on a recently published focused exegetic work, the Essential Message of Islam [Amana Publications, USA- 2009] that is duly approved by al-Azhar al-Sharif and endorsed and authenticated by Dr. Khaled Abou El Fadl, Alfi Distinguished Professor of Law at the UCLA School of Law.

The Qur'anic pronouncement "not to insult those whom others (lit., 'they') invoke besides God" (6:108) is a clear reminder against profaning any deity, idol or symbols held sacred by other people. The Qur'an, however, does not prescribe any punishment for the offenders. It warns humanity that there will always be some people who will hurl seductive remarks at the Prophet (6:113) or be inimical to him (25:31) for fun or cupidity and asks the believers to simply ignore them. In other words, the Qur'an treats blasphemy as a moral vice and does not regard it as a punishable/ criminal offence.

The Meccan enemies of the Prophet called him impostor, a madman (30:58, 44:14, 68:51), and an insane poet (37:36). They ridiculed the Qur'anic revelation (18:56, 26:6, 37:14, 45:9), which they declared to be strange and unbelievable (38:5, 50:2), a jumble of dreams(21:5) and legends of the ancients (6:25, 23:83, 25:5, 27:68, 46:17, 68:15, 83:13). They accused the Prophet of forging lies and witchcraft (34:43, 38:4), forging lies against God, forgery and making up tales (11:13, 32:3, 38:7, 46:8), witchcraft (21:3, 43:30, 74:24), obvious witchcraft that was bewildering (10:2, 37:15, 46:7), and of being bewitched or possessed by a Jinn (17:47, 23:70, 34:8). By definition, all these accusations were blasphemous. Nowhere in its text does the Qur'an prescribe any punishment for those who uttered these blasphemies.

The advocates of blasphemy law may raise the following points:

1. The slanderer and maligner of the Prophet can upset peace and harmony like priests of Cordova (Spain, 851-859) [1].

2. Maligning any religion, religious leader, text etc. purports to demonize and dehumanize it and can fuel hatred, religious bigotry and animosity, and in the present day context, feed Islamophobia and Islamofacism.

The arguments appear convincing but there are more compelling grounds against prescribing any punishment for blasphemy.

The highly porous and subjective character of the 'offense' (blasphemy) can lead to a chaotic situation within the Muslim community and persecution of the minority community as is happening in Pakistan these days.

An uncouth citizen can use it to settle a score with a non-Muslim or even a Muslim neighbour or financially exploit him by a threat of blasphemy charge.

An Islamic State can use it for political repression of dissidents.

By strict application of blasphemy law in a broader sense, a Sunni Sharia Court can charge the entire Shia community of blasphemy for their invectives against the Prophet's close relatives - the first three Caliphs, who were either his father-in-law (Abu Bakr and Umar) or son-in-law (Uthman).

The theologians in the Islamic heartlands can issue an endless stream of fatwas for the heads of the countless Islam bashing scholars and writers, whose speech, writing and symbolism can sometimes be construed as blasphemous.

The very notion of killing a person for blasphemy contradicts the Qur'anic cardinal principle of justice that relates only to offences committed against fellow humans.

Conclusion: The relativism and porosity in the definition of 'blasphemy' can open a floodgate of blasphemy charges against unsuspecting individuals, members of the minority, Muslim sects and Islam.critcal scholars and writers. Since the Qur'an, conceivably cognizant of these caveats, does not  prescribe any punishment for blasphemy, the blasphemy law needs to be repealed. Blasphemy symbolizes and epitomises hatred that inevitably breeds hatred - regardless of any law against it. This can in turn feed radicalisation, foster terrorism, and trigger communal riots. Muslim jurists will do better by insisting on getting a firm Security Council Code of Conduct and may be limited punishment for blasphemy depending upon the gravity and potential impact of the offence and the attitude of the offender, rather than legislating a capital punishment or even, any punishment for blasphemy - which remains a porous act of misconduct and moral turpitude.

Notes
[1]. Between 851 and 859, some priests in Cordova, now southern Spain, used to utter in public places highly insulting and abusive remarks against the Prophet deliberately seeking capital punishment. They were an embarrassment to both the Christian community and the Emir and were executed by application of Sharia law as this was the only way to prevent them from a highly provocative behaviour in public.

Muhammad Yunus, a Chemical Engineering graduate from Indian Institute of Technology, and a retired corporate executive has been engaged in an in-depth study of the Qur'an since early 90's, focusing on its core message. He has co-authored the referred exegetic work, which received the approval of al-Azhar al-Sharif, Cairo in 2002, and following restructuring and refinement was endorsed and authenticated by Dr. Khaled Abou El Fadl of UCLA, and published by Amana Publications, Maryland, USA, 2009.

Muslims Condemn Blasphemy Charges against Christian Teen in Pakistan

Blasphemy has become a tool of harassment to a few who have nothing better to do than create chaos. We ask the people of Pakistan to seriously debate the blasphemy laws. Islam is about free will and as Muslims we need to stand against any oppression towards any human being following in the footsteps of the prophet.

Blasphemy Laws go against Islam

Appended below are verses from Quraan.
Secure men believe in God and the Day of Judgment and have full faith that God alone decides what is in one’s heart. Insecure men's way to find solutions is to eliminate the other with power, screams, deaths and threats.

Unless a few of us start speaking against Blasphemy, the evil vigilantist anti-Islamic practice of insecure men will continue.

Except the first four caliphs, who were chosen to govern rather than forcefully taking over,  we have a bad history of oppression.  Have we ever been ruled by sane men? It is not just us, until 100 years ago with the exception of the United States; the whole world was run by dictators and kings. Most nations are moving towards civil societies run by the consensus of the people and sadly our freedom is not proportional.

Look at our history, we have been prevented from independent inquiry, we were imposed by the damned dictators and kings. Thank God we have Turkey, Bangladesh, Malaysia and Indonesia, and Pakistan (occasionally), where the civil society rules. Islam will do well in democracies and freedom.

Unfortunately Muslims do not have the breathing room to be themselves, they are continuously bonded by one tyrant or the other… We certainly can pray asking God to help Muslims to be free to govern themselves and not throw them in the mouths of Mullahs from the dictators. One bad Mubarak goes and the brotherhood is out there to force their laws on the unwilling people…

We the Muslims have been reduced to Pavlovian Muslims - we are too damned conditioned with the laws of men like Zia, Wahhab, Maududi, Banna and others,   rather than guidance of God. We need to be free, and do our Iqra.

Prophet Muhammad said, I am leaving this book to you - he did not say, well, I have assigned the interpretation of the book to the Imams, Kings and the dictators... you don't need to read the Quran any more, just follow the rules made by the dominant partners of God, you will get a free pass on the Day of Judgement. They will take care of you.

Time to start from Zero and listen to the Prophet and not the Great Imams of the past, following them has made us cowards and insecure with Blasphemy and Apostasy laws that go against God's will.

Here are the verses from Quraan, compiled by Irtaza.

[5:57] O you who believe, do not befriend those among the recipients of previous scripture who mock and ridicule your religion, nor shall you befriend the disbelievers. You shall reverence GOD, if you are really believers.

[6:68] If you see those who mock our revelations, you shall avoid them until they delve into another subject. If the devil causes you to forget, then, as soon as you remember, do not sit with such evil people.

[18:106] Their just requital is Hell, in return for their disbelief, and for mocking My revelations and My messengers.

[39:48] The sinful works they had earned will be shown to them, and the very things they used to mock will come back to haunt them.

[45:33] The evils of their works will become evident to them, and the very things they mocked will come back and haunt them.

Why the Muslim masses ignore the Messenger Muhammad?  Who they want to please?
The punishment is delivered by God, not by you or me.
The killing is justified only if  people wage  war against you. You may kill them, in that case:

[5:33] The just retribution for those who fight GOD and His messenger, and commit horrendous crimes, is to be killed, or crucified, or to have their hands and feet cut off on alternate sides, or to be banished from the land. This is to humiliate them in this life, then they suffer a far worse retribution in the Hereafter.

The killing is not justified if people evict you. You may only evict them:

[2:191] You may kill those who wage war against you, and you may evict them whence they evicted you. Oppression is worse than murder. Do not fight them at the Sacred Masjid, unless they attack you therein. If they attack you, you may kill them. This is the just retribution for those disbelievers.

The killing is not justified if people insult the Prophet. God will take care of it.

[18:106] Their just requital is Hell, in return for their disbelief, and for mocking My revelations and My messengers

And, these are some of the Quranic wisdoms:

[42:37] They avoid gross sins and vice, and when angered they forgive

[42:40] Although the just requital for an injustice is an equivalent retribution, those who pardon and maintain righteousness are rewarded by GOD. He does not love the unjust.

The Muslim masses need to learn a lot from the Quran.  They are shackled by their Ulams and Allamas!

 Irfan sahib,
It is illogical that in a Muslim state Prophet will be insulted and the offender will not be punished. Dr  Hashim Kamali has concluded in chapter on Blasphemy in his book  the Freedom Of Expression in Islam that blasphemy is punishable under Taziir and the punishment will depend on the level of offence. I feel he is right.

 Dear Mr. Hannan,
Please do not insult the Qur'anic teachings.  The Qur'an does not require us to punish blasphemy in THIS world.  It's solely Allah's territory and He will deal with the blasphemers as He sees fit.  Why do you want to kill the blasphemer when Allah has declared ALL murders unlawful (except when the  are legally justified-and blasphemy is NOT one of them)?  Do you blood on your hands?

Even the prophets were badly insulted during their lifetimes and Allah threatened the blasphemers to punish them Himself---Here and in the Hereafter.  Only He has this prerogative, no one else.  This is because the blasphemer must be allowed to have their natural life to repent  at any time, and this opportunity must not be taken away from them.  I hope you understand the difference between insulting and spreading widespread corruption on the Earth.

Follow up on Asia Bibi Petition

Appeal for Justice to Pakistani Asia Bibi and Mercy to mankind
The following note is in response to the comments floating on the internet in the last few hours.  Please read some of the comments, an amazing mind-set is in the works. http://worldmuslimcongress.blogspot.com/2011/01/follow-up-on-asia-bibi-petition.html
As people of faith, also should be known as peace makers, we cannot cause people in conflict to dig in their heels and take positions, we have to mitigate conflicts and nurture goodwill for the ultimate good of all. Prophet Muhammad (pbuh) applied that method in many of his examples.  I hope you understand the avoidance of such language in the petition.
Three (of the thousands on my list) individuals wrote, “It is too much. You are really becoming a problem for Ummah. Why are you aggravating the situation? Do you know what are you are going to lose - your both the worlds perhaps?” Another one writes, “Islamically, insults and abuses against the Prophet Muhammad, pbuh, count as acts of war and rebellion against a justly created Islamic entity. The Qur'an commands terrible punishment for such acts of war. “Finally, the third one writes, “Salman was a shame on Islam”.

Those were the right wingers among Muslims, a minuscule, statistically insignificant number of people but can become players by shining the media light on them. These guys are fodder for the other right wingers;  among Republicans and the Fox people. The left on the other hand shouts that we have to declare a war on right wingers. Mahatma Gandhi had aptly said an eye for an eye will make the whole world blind.

Prophet Muhammad’s wisdom comes as guiding light; follow the middle path. Every one has a God given space, if we can learn to respect that, conflicts fade and solutions emerge. Keeping that in mind, we have crafted the appeal with a clear goal of finding solutions, which is a deep desire in all parties.

As moderates we are an overwhelming majority, we can express our support to the middle path and ask the extremists to study the prophet and spread goodness in his name and not oppression.

Appeal for Justice to Asia Bibi and mercy to mankind

To:  The People, Ulema and Government of Pakistan

Prophet Muhammad (pbuh) is a mercy to mankind, he is indeed a blessing to the humanity and rightfully known as Rahmutul Aalameen. There are innumerable examples of forbearance, forgiveness and kindness of the prophet (pbuh) towards those who insulted and even tried to harm him.

One of the most famous stories, often repeated is about an old lady who threw trash on the prophet every time he passed in front of her door. One day, the trash was not thrown. Concerned, he asked the neighbors and found that she was sick. He knocked on her door to and offered help. Overwhelmed with kindness and love, she chose to become a Muslim.

Once on way to the city of Taif, the Prophet was pelted with rocks by miscreants, his associates wanted to retaliate, even the arch angel Gabriel offered to help bring relief to the situation. The prophet said no, instead he asked God to forgive them, because he was the last messenger. If they are destroyed to whom would he preach? He hoped that if not them, their progeny at will accept the God-sent message to mankind.

He enjoined us that "if any one eats a full meal when his neighbor is hungry or starving, then he is not from among us". He never said 'Muslim neighbor'. He loved humanity and asked Muslims to be role models of charity, kindness, concern and love to all.

What was the need for the Prophet to have endured such painful experiences? It was to guide humanity towards kindness, and shape long term solutions for peaceful communities and the greater good of the society at large. He was committed to mitigating conflicts and nurturing goodwill, indeed he was the ultimate peace maker, the mercy to mankind.

As Muslims we need to keep his message of kindness alive and bring to fruition what he was all about; Rahmutul- Aalameen. Let the mercy and kindness he taught become a blessing to the universe and continue to shower on humanity.

We appeal to the Ulema, thoughtful people and the Government of Pakistan to give life to the examples of the Prophet in representing to Asia Bibi. What would Rahmutul Aalameen have done?

Asia Bibi is not a Muslim and is relegated to menial work that is considered unclean (Napak) by others, who consider themselves to be good Muslims, denied her water from the common source. Is this not a most egregious insult, and the denial of water, the same as denial to sustain life?

First of all he would not have denied Asia Bibi the water of life, indeed in another famous occurrence a person fed water to a thirsty animal and the Prophet had said God will grace the person for that act of kindness. He would have been kind and magnanimous and would probably have us pray for Asia Bibi’s well being. God loves the forgivers and those who repent.

As Muslims we need to keep his message of kindness alive and bring to fruition what he was all about; Rahmutul- Aalameen. Let the mercy and kindness he taught become a blessing to the universe and continue to shower on humanity.

We owe an apology to Asia Bibi, her family and the Christian community. We should build goodwill in our and their hearts.

We ask the people of Pakistan to seriously debate about the blasphemy laws. The violent silencing of Governor Salman Taseer calls for an immediate need for a discussion on the topic. Islam is about free will and as Muslims we need stand against any oppression towards any human being following in the footsteps of the prophet. Amen!

Planned Muslim Response to Qur'an Burning by Pastor Jones on September 11 in Mulberry, Florida

PRESS RELEASE

PLANNED MUSLIMS RESPONSE TO QUR'AN BURNING BY PASTOR JONES ON 9/11/13 IN MULBERRY, FLORIDA

We as Muslims plan to respond to pastor Terry Jones' planned burning of 3000 copies of Quran on September 11, 2013 in positive terms.

Our response - we will reclaim the standard of behavior practiced by the Prophet concerning “scurrilous and hostile criticism of the Qur’an” (Muhammad Asad Translation Note 31, verse 41:34). It was "To overcome evil with good is good, and to resist evil by evil is evil." It is also strongly enjoined in the Qur’an in the same verse 41:34, “Good and evil deeds are not equal. Repel evil with what is better; then you will see that one who was once your enemy has become your dearest friend.”

God willing Muslims will follow the divine guidance and pray for the restoration of Goodwill, and on that day many Muslim organizations will go on a “blood drive” to save lives and serve humanity with kindness.

We invite fellow Americans of all faiths, races, and ethnicities to join us to rededicate the pledge, “One nation under God”, and to build a cohesive America where no American has to live in apprehension, discomfort or fear of fellow Americans. This event is a substitute for our 10th Annual Unity Day Celebration (www.UnitydayUSA.com) held in Dallas, but now it will be at Mulberry, Florida.

Unwittingly Pastor Jones has done us a favor by invigorating us by his decision to burn nearly 3000 copies Quran on September 11, 2013. Obviously he is not satisfied by the notoriety he garnered by burning one Qur'an last year.

As Muslims and citizens we honor the free speech guaranteed in our constitution. We have no intentions to criticize, condemn or oppose Pastor Terry Jones' freedom of expression. Instead, we will be donating blood and praying for goodness to permeate in our society.

We plan to follow Jesus Christ (pbuh), a revered prophet in Islam as well as Prophet Muhammad (pbuh) – that of mitigating the conflicts and nurturing good will for the common good of the society.

We hope, this event and the message will remind Muslims elsewhere in the world as well, that violence is not the way. Muslims, who react violently to senseless provocation, should realize that, violence causes more violence, and besmirches the name of the religion that we hold so dear. We believe that Prophet Muhammad was a mercy to the mankind, and we ought to practice what we believe and preach. We must not insult Islam by the negative reactions of a few.

We can only hope it will bring about a change in the attitude of the followers of Pastor Jones, and in the behavior of those Muslims who reacted violently the last time Pastor sought notoriety – We hope this small step towards a bridge to peaceful coexistence would propel us towards building a cohesive society.

Like most Americans a majority of Muslims quietly go about their own business, but it is time to speak up and take positive action instead of negative reaction. May this message of peace and goodwill reverberate and reach many shores.

Lastly, we appreciate the Citizens of Mulberry, Florida, Honorable Mayor George Hatch, City Commissioners, police and Fire Chiefs for handing this situation very well. This will add a ‘feather of peace’ in the City’s reputation. We hope Mulberry will be a catalyst in showing the way in handling conflict with dignity and peace.

We thank the Media for giving value to the work towards peace rather than conflict.

Thank you.

CIVIL DIALOGUE

The people in Dallas are making an effort to understand and clean their own hearts first, when we are free from bias, it would be easy to share that with others. Islam teaches us in so many ways to "respect the otherness of others" and it is time we find simple practical ways of doing it.
