Ulama and Islamic Values - Dr. Asghar Engineer

URL: http://worldmuslimcongress.blogspot.com/2012/07/ulama-and-islamic-values-dr-asghar.html

AA

Thank you Asghar Bhai,

Please keep up your work, it is not reform, but rather removing the dust gathered on pristine Islam.  Today, there are more and more people appreciating your work, and we just need to work on building that momentum and have them speak up.

Some of the good things of Islam seem Khokla, empty, when a few of these ulema talk about women having equal rights, without meaning it. One prominent Muslim leader shamelessly uttered, “we were the first ones to give them equal rights” baloney! We did not give them any rights, God had given them those inalienable rights, and we the men had usurped it, and thank the Prophet for restoring them.

And yet they remain silent when an idiot dumps a woman in three bloody words, throwing her whole world into chaos and Zulm. Those women who were thrown on the street with children and no source to support them may not admit that the prophet’s religion as practiced is a zulmat and not the Rahmat we proclaim. Triple Talaq needs to go, but we have to work at it, let some of these Ulema actually understand Islam and read Quraan.

The Prophet was Rahmatul Aalameen; and all we have to do is match our talk with our acts by following the Quraan.

If Islam can be translated into one word, it would be Justice. Justice is the mother cure for all ailments of the society.

In the years of work you have shaped, you must have noticed the improvements from belligerent opposition to somewhat simple opposition, and it is a positive change. I have noticed dramatic changes in the last 10 years in the Muslim forums, including the ones I moderate. When I started talking about Pluralism in Islam - I was vehemently attacked in my own forums and every Muslims forum, thank God, today, their fears are subsiding and they see that the pluralistic values are embedded in Islam and Islam is about Universality. Today, just about every scholar is writing about Pluralism in Islam. Insha Allah, we have to continue the work.

I am blessed to live in America, and have a lot more freedom available to me, to write freely, rather than threatened by the fatwa bombs. Someone tried to bring one from Karachi on me, and I told them to go ahead and make my day, they did not give me that pleasure.

Islam is a summation of the beauty of all religions, while all religions are beautiful in themselves, and we cannot let a few ruin the beauty of Islam. Keep up the good work.

Jazak Allah Khair

ULAMA AND ISLAMIC VALUES
Asghar Ali Engineer

A few days ago we had organized a discussion on codification of Muslim personal law in a way that could be acceptable to all the sects of Islam in India. We have done so in consultation with the ulama Muslim intellectuals, lawyers and women activists. Also, this codification is strictly with frame-work of Shari’ah that is Qur’an and sunna. We have had a few consultations before we finalized certain proposals and we also had kept in view the codification done in many Muslim countries like Pakistan, Jordan, Egypt and other countries.

Our draft codified law addresses the question of misuse of polygamy, triple talaq, inheritance, custody of children etc. The orthodox Ulama who have constituted the Muslim Personal Law Board since seventies of last century, hardly do anything to stop misuse of these provisions with the result that a large number of Muslim women suffer – are arbitrarily divorced ruining their lives for ever and throwing their children in an uncertain future. Many men taking advantage of provision for polygamy desert their fist wives and marry another one and in order to take revenge do not even divorce them as under unregulated Muslim personal law today khula’ cannot take place without the consent of husband.

Our proposed codification is chiefly meant to stop such abuses and restore its thrust for justice and gender equality. Though we have finalized proposals we, by no means, consider it perfect and so have kept it open for consultation and further perfection. Continuing with consultation we organized one such consultation at Lucknow which is a centre of Islamic learning and invited ulama from Nadwat-ul-Ulama and Farangi Mahal, the two great centres of Islamic learning, besides other Ulama, intellectuals and women activists.

Though we are aware that it is by no means easy to get such proposals accepted by orthodox Ulama or Muslim Personal Law Board (MPLB) we continue to discuss with them and persuade them to accept these proposals in the interest of Islamic spirit and justice to women. We also wish to have dialogue with MPLB, preferably its chief Maulana Rabe Hasni. In this consultation we requested that MPLB should depute some representative to have at least preliminary discussion with us.

A maulana was deputed and from Farangi Mahal its chief Maulana Irfan Siddiqui himself came. The consultation was great disappointment and proved how rigid our Ulama are and one of the reasons why Islam appears to be so rigid to non-Muslims and rationalist Muslims is chiefly because of this rigidity. Right at the beginning the Maulana from Nadwa (I am not naming him) right in the beginning said you are undertaking very ‘dangerous’ work (khaufnak kam kar rahen hain).

He also alleged that you are trying to ‘change Qur’an.’ I said let us first go through the proposals and then you point out why it is ‘dangerous’ and how it amounts to change Qur’an. We again reiterated that our proposals are strictly within the frame-work of Qur’an and sunnah, all we are doing is to regulate and pre3vent their misuse like polygamy, triple divorce etc. We have proposed, for example, that a man should not be allowed to marry another wife unless he is permitted to do so by the marriage council (or shari’ah court) presided by a qazi and his first wife after thorough inquiry which could include need for second wife and his capacity to do justice.

Both the Qur’anic verses in on polygamy in Qur’an (4:3 and 4:129) stress justice, not number and justice is very primary in Islamic value system too and in taking second wife too justice cannot be ignored. The Maulana then said it is Hindus who marry more than one wife more often than Muslims. I said so what, we are here discussing the Muslim Personal Law and not Hindu law or violation of Hindu law. We must understand the maqasid al-shari’ah (intentions of shari’ah) and should not go by formal law as formulated by early jurists. In fact early jurists also had kept justice in mind and even tried to define justice but soon it began to be misused by men and justice became quite secondary to number (upto four)

Similarly triple divorce in one sitting is not mentioned in Qur’an and Qur’an has clearly prescribed method also and requires two witnesses at the time of divorce (65:1-3) and yet among Hanafi Muslims triple divorce in one sitting has become the only form of divorce in India. Qur’an also makes provision for arbitration before divorce (4:35) which is also avoided today. Thus Qur’an becomes secondary when it comes to men’s domination.

The Maulana said if I prove the Propjet (PBUH) had allowed triple divorce would you accept it? I said surely I would. Please quote the source. He could not and then I quoted the hadith in which the Prophet (PBUH) had strongly denounced triple divorce when Rukkana divorced his wife thrice in one sitting. The Maulana had no reply but again he said very few Muslims divorce their wives. One ‘alim even said none of us present here has divorced his wife. I said we are not going by numbers but quality and intent of law, not how many Muslims divorce their wives. I know of several Muslim women whose lives have been ruined because of triple divorce.

The Maulana when rendered speechless adopted tactics of munazarah (debate) in which matter is twisted rather than give solid reply. The Maulana at last left in a huff rather than give any constructive suggestion. I was very much pained that our religious leaders are so rigid and have lost the true spirit of Islamic legislation.

Divorce and Islam | Deviant practice of triple Talaq

When it comes to flipping the scripture to suit men’s ego, Islam is no different than Christianity, Judaism or other faiths. Instead of looking down upon ourselves, we need to find ways to restore Islam to what Quraan guides us.

I wrote an article on the deviant practice of triple Talaq that cause my friend Mohammad Irtaza to compile verses from Quraan. Those who are familiar with American laws of divorce find them in tune with Quraan; serving justice to both men and women.

As a habit, I have randomly checked the translations provided and have doubled on some with translations from Muhammad Asad.  After debating and chasing a few Neocons for nearly a decade, and managing the Quraan conference in 2010, I have come to practice what I preach – read the actual Quraan, and check at least three different translations to ensure that it makes sense. Quraan is a common sense book of guidance to me.

If the words don’t make sense, then the problem is translations and not the word of God. Men and women are each other’s garments, declares the Quraan. Meaning both are equally responsible for each other’s joy, care, kindness and happiness. No one was burdened more than the other.

Garment verse

Foundation of marriage

Marriage is a bond between man and woman. God Almighty discourages divorce as understood from many verses of the Quran.

God Almighty dictates a pre-divorce interim for four months and the reason is stated very clearly in the Quran.

[2:226] Those who intend to divorce their wives shall wait four months (cooling off); if they change their minds and reconcile, then GOD is Forgiver, Merciful.

2:226 (Asad) Those who take an oath that they will not approach their wives shall have four months of grace; and if they go back [on their oath] -behold, God is much-forgiving, a dispenser of grace.

[2:227] If they go through with the divorce, then GOD is Hearer, Knower.
2:227 (Asad) But if they are resolved on divorce -behold, God is all-hearing, all-knowing.

[4:35] If a couple fears separation, you shall appoint an arbitrator from his family and an arbitrator from her family; if they decide to reconcile, GOD will help them get together. GOD is Omniscient, Cognizant.

4:35 (Asad) And if you have reason to fear that a breach might occur between a [married] couple, appoint an arbiter from among his people and an arbiter from among her people; if they both want to set things aright, God may bring about their reconciliation. Behold, God is indeed all-knowing, aware.

[30:21]. Among His proofs is that He created for you spouses from among yourselves, in order to have tranquility and contentment with each other, and He placed in your hearts love and care towards your spouses. In this, there are sufficient proofs for people who think.

God Almighty also dictates a post-divorce interim and the reason is stated very clearly. Additionally, woman's right after divorce is reserved!

[2:228] The divorced women shall wait three menstruations (before marrying another man). It is not lawful for them to conceal what GOD creates in their wombs, if they believe in GOD and the Last Day. (In case of pregnancy,) the husband's wishes shall supersede the wife's wishes, if he wants to remarry her. The women have rights, as well as obligations, equitably. Thus, the man's wishes prevail (in case of pregnancy). GOD is Almighty, Most Wise.

[65:5] This is GOD's command that He sends down to you. Anyone who reverences GOD, He remits his sins, and rewards him generously.

[2:231] If you divorce the women, once they fulfill their interim (three menstruations), you shall allow them to live in the same home amicably, or let them leave amicably.Do not force them to stay against their will, as a revenge. Anyone who does this wrongs his own soul. Do not take GOD's revelations in vain. Remember GOD's blessings upon you, and that He sent down to you the scripture and wisdom to enlighten you. You shall observe GOD, and know that GOD is aware of all things.

2:231 (Asad) And so, when you divorce women and they are about to reach the end of their waiting-term, then either retain them in a fair manner or let them go in a fair manner. But do not retain them against their will in order to hurt [them]: for he who does so sins indeed against himself. And do not take [these] messages of God in a frivolous spirit; and remember the blessings with which God has graced you, and all the revelation and the wisdom which He has bestowed on you from on high in order to admonish you thereby; and remain conscious of God, and know that God has full knowledge of everything.

[2:232] If you divorce the women, once they fulfill their interim, do not prevent them from remarrying their husbands, if they reconcile amicably. This shall be heeded by those among you who believe in GOD and the Last Day. This is purer for you, and more righteous. GOD knows, while you do not know.

[2:233] Divorced mothers shall nurse their infants two full years, if the father so wishes. The father shall provide the mother's food and clothing equitably. No one shall be burdened beyond his ability. No mother shall be harmed on account of her infant, nor shall the father be harmed because of his infant. (If the father dies), his inheritor shall assume these responsibilities. If the infant's parents mutually agree to part, after due consultation, they commit no error by doing so. You commit no error by hiring nursing mothers, so long as you pay them equitably. You shall observe GOD, and know that GOD is Seer of everything you do.

[65:6] You shall allow them to live in the same home in which they lived with you, and do not make life so miserable for them that they leave on their own. If they are pregnant, you shall spend on them until they give birth. If they nurse the infant, you shall pay them for this service. You shall maintain the amicable relations among you. If you disagree, you may hire another woman to nurse the child.

65:6 (Asad) [Hence,] let the women [who are undergoing a waiting-period] live in the same manner as you live yourselves, In accordance with your means; and do not harass them with a view to making their lives a misery. And if they happen to be with child, spend freely on them until they deliver their burden; and if they nurse your offspring [after the divorce has become final], give them their [due] recompense; and take counsel with one another in a fair manner [about the child's future]. And if both of you find it difficult [that the mother should nurse the child], let another woman nurse it on behalf of him [who has begotten it].

[65:7] The rich husband shall provide support in accordance with his means, and the poor shall provide according to the means that GOD bestowed upon him. GOD does not impose on any soul more than He has given it. GOD will provide ease after difficulty.
A post-divorce interim is not required in the following situation.

[33:49] O you who believe, if you married believing women, then divorced them before having intercourse with them, they do not owe you any waiting interim (before marrying another man). You shall compensate them equitably, and let them go amicably.
God Almighty discourages divorce and divorce may be retracted twice.

Marriage is a sacred bond between man and woman and therefore, should be taken very seriously! The couple may not get another chance to remarry each other after third divorce, because of the condition they need to meet as stated in verse 2:230 below!

[2:229] Divorce may be retracted twice. The divorced woman shall be allowed to live in the same home amicably, or leave it amicably. It is not lawful for the husband to take back anything he had given her. However, the couple may fear that they may transgress GOD's law. If there is fear that they may transgress GOD's law, they commit no error if the wife willingly gives back whatever she chooses. These are GOD's laws; do not transgress them. Those who transgress GOD's laws are the unjust.

[2:230] If he divorces her (for the third time), it is unlawful for him to remarry her, unless she marries another man, then he divorces her. The first husband can then remarry her, so long as they observe GOD's laws. These are GOD's laws; He explains them for people who know.

2:230 (Asad) And if he divorces her [finally], she shall thereafter not be lawful unto him unless she first takes another man for husband; then, if the latter divorces her, there shall be no sin upon either of the two if they return to one another-provided that both of them think that they will be able to keep within the bounds set by God: for these are the bounds of God which He makes clear unto people of [innate] knowledge.

My (Mike Ghouse) understanding – God prefers the couple to be married for good, and does not like divorce.  In the situation 2:230, it was to discourage men and women to divorce and recognize the consequences of such eventuality.  Going through the hoops could do two things – establish that they really want each other and are willing to go through the difficult process, or if there is no such strength in the relationship, it will end there anyways.

People who do not seek guidance from the Quran and follow scholar's opinion are addressed by the following verses.

[9:31] They have set up their religious leaders and scholars as lords, instead of GOD. Others deified the Messiah, son of Mary. They were all commanded to worship only one god. There is no god except He. Be He glorified, high above having any partners.

[9:34] O you who believe, many religious leaders and preachers take the people's money illicitly, and repel from the path of GOD. Those who hoard the gold and silver, and do not spend them in the cause of GOD, promise them a painful retribution.

[63:4] When you see them, you may be impressed by their looks. And when they speak, you may listen to their eloquence. They are like standing logs. They think that every call is intended against them. These are the real enemies; beware of them. GOD condemns them; they have deviated.

The Quran is a perfect, complete and fully detailed book for us to follow. The Quran is the only Hadith to be obeyed!

[11:1] A.L.R. This is a scripture whose verses have been perfected, then elucidated. It comes from a Most Wise, Most Cognizant.

[41:3] A scripture whose verses provide the complete details, in an Arabic Quran, for people who know.

[45:6] These are GOD's revelations that we recite to you truthfully. In which Hadith other than GOD and His revelations do they believe?

Planned Muslim Response to Qur'an Burning by Pastor Jones on September 11 in Mulberry, Florida

PLANNED MUSLIMS RESPONSE TO QUR'AN BURNING BY PASTOR JONES ON 9/11/13 IN MULBERRY, FLORIDA

We as Muslims plan to respond to pastor Terry Jones' planned burning of 3000 copies of Quran on September 11, 2013 in positive terms.

Our response - we will reclaim the standard of behavior practiced by the Prophet concerning “scurrilous and hostile criticism of the Qur’an” (Muhammad Asad Translation Note 31, verse 41:34). It was "To overcome evil with good is good, and to resist evil by evil is evil." It is also strongly enjoined in the Qur’an in the same verse 41:34, “Good and evil deeds are not equal. Repel evil with what is better; then you will see that one who was once your enemy has become your dearest friend.”

God willing Muslims will follow the divine guidance and pray for the restoration of Goodwill, and on that day many Muslim organizations will go on a “blood drive” to save lives and serve humanity with kindness.

We invite fellow Americans of all faiths, races, and ethnicities to join us to rededicate the pledge, “One nation under God”, and to build a cohesive America where no American has to live in apprehension, discomfort or fear of fellow Americans. This event is a substitute for our 10th Annual Unity Day Celebration (www.UnitydayUSA.com) held in Dallas, but now it will be at Mulberry, Florida.

Unwittingly Pastor Jones has done us a favor by invigorating us by his decision to burn nearly 3000 copies Quran on September 11, 2013. Obviously he is not satisfied by the notoriety he garnered by burning one Qur'an last year.

As Muslims and citizens we honor the free speech guaranteed in our constitution. We have no intentions to criticize, condemn or oppose Pastor Terry Jones' freedom of expression. Instead, we will be donating blood and praying for goodness to permeate in our society.

We plan to follow Jesus Christ (pbuh), a revered prophet in Islam as well as Prophet Muhammad (pbuh) – that of mitigating the conflicts and nurturing good will for the common good of the society.

We hope, this event and the message will remind Muslims elsewhere in the world as well, that violence is not the way. Muslims, who react violently to senseless provocation, should realize that, violence causes more violence, and besmirches the name of the religion that we hold so dear. We believe that Prophet Muhammad was a mercy to the mankind, and we ought to practice what we believe and preach. We must not insult Islam by the negative reactions of a few.

We can only hope it will bring about a change in the attitude of the followers of Pastor Jones, and in the behavior of those Muslims who reacted violently the last time Pastor sought notoriety – We hope this small step towards a bridge to peaceful coexistence would propel us towards building a cohesive society.

Like most Americans a majority of Muslims quietly go about their own business, but it is time to speak up and take positive action instead of negative reaction. May this message of peace and goodwill reverberate and reach many shores.

Lastly, we appreciate the Citizens of Mulberry, Florida, Honorable Mayor George Hatch, City Commissioners, police and Fire Chiefs for handing this situation very well. This will add a ‘feather of peace’ in the City’s reputation. We hope Mulberry will be a catalyst in showing the way in handling conflict with dignity and peace.

We thank the Media for giving value to the work towards peace rather than conflict.

CIVIL DIALOGUE

The people in Dallas are making an effort to understand and clean their own hearts first, when we are free from bias, it would be easy to share that with others. Islam teaches us in so many ways to "respect the otherness of others" and it is time we find simple practical ways of doing it.
